The law that applies to a situation where the parties reside in one state but were married in another state depends on where you seek to get the divorce. You can file for divorce in the state in which you live, and in that case, the laws of that state control.
In all states, you do not need to prove that something was wrong to get a divorce - you can file for a no fault divorce, citing irretrievable breakdown or irreconcilable differences or any other reason legally recognized in your states. You need not prove why the marriage fell apart. To get a no fault divorce, in many states you must be legally separated for a given length of time before you can divorce. In other states, such as Florida, there is no waiting period. |
