What is Legal Custody?

As a parent, either the court or you will decide who gets legal custody of your child or children. Legal custody means you are charged with your children’s health care, education, religion, etc. The court, or by agreement you, will decide if you will get sole custody of your children – meaning you will be solely responsible for the welfare of your children – or if you and your spouse will maintain joint custody, i.e., you will share the decision-making responsibilities.
