Copyrights generally protect works of art, including poetry, movies, video games, DVDs, paints, sculptures, musical works, photographs, or architectural designs, among others. To qualify for a copyright, the work must be “fixed in a tangible medium of expression.” In other words, the work must exist in some physical form, such as a tape recording, on film, on paper, or even in an email. Additionally, a copyrighted work must be original, i.e. the author must have created it independent of another work. Furthermore, the work must have a modicum of creativity to qualify as copyrighted – facts, such as a phone book listing, contain no creativity and thus does not qualify for copyright protection (though, the structure or layout of arrangement of a phone book may qualify for copyright protection). |
