You've been in your house for years. You love it. You enjoy looking out your window every morning, checking out the birds or the people walking by on the sidewalk. Then, your **** neighbor's tree begins to get in the way of your view, and she absolutely refuses to cut down the tree, or even trim a little so you get back your view. So, what can you do?
Unfortunately, in most cases, there's not much you can do. Unless their is a zoning or subdivision law already in place, or a view ordinance in your town, you have no zoning rights to light, air, or view - though, in most cases, your neighbor cannot deliberately block your view with a structure that has no use to your neighbor - for instance, by sticking a neon sign next to your window offering free beer, if in fact your neighbor is not making such an offer.
If there are no laws currently in place, your best bet is to go ask your neighbor nicely to remove the tree. Failing that, you may want to find another window to look out of. |
