Aviation law is the combination of federal, state, and local laws pertaining to the creation, development, and operation of airports. Aviation law also covers violations of the Federal Aviation Agency (FAA ) regulations, accidents caused by faulty airplanes, accidents caused by pilots, and lawsuits brought by the survivors of air crashes. Most aviation law is federally based, and, in fact, most states are prohibited from regulating rates, routes, or other services of airline carriers. While a carrier of passengers by aircraft is not an insurer of the passengers' safety, such a carrier is under the duty to exercise either a high or the highest degree of care for the safety of its passengers, such care being required not only in the operation of the plane, but also with respect to its equipment and maintenance. Nevertheless, a court will not hold an air carrier liable for all accidents that might occur on one of the air carrier's planes. Thus, if the air carrier did exercise the highest degree of care, but weather or some latent defect in the airplane caused harm, the airline can be legally excused. The leading causes of commercial airline accidents include engine failures, controlled flight into terrain, approach and landing, loss of control, runway incursions, and weather.
